Kevin Spacey to face a new trial over sex abuse claims

It comes just a week after the double Oscar winner said he would voluntarily appear in a British court over four counts of sexual assault against three men.The Hollywood actor had long been attempting to get the case dismissed, but US District Court Judge Lewis A Kaplan ruled Rapp can pursue his allegations of battery and intentional infliction of emotional distress.The judge, however, dismissed one of the allegations against Spacey as the claim did not fall under the New York State Child Victims Act, which allows claims outside the statute of limitations.Rapp accuses Spacey of groping his buttocks in 1986, when he was aged 14-years-old. According to the order from Judge Kaplan, the incident took less than two minutes and Rapp testified in his deposition that there was “no kissing, no undressing, no reaching under clothes, and no sexualised statements or innuendo.”In his ruling, Judge Kaplan said there is a “genuine issue of material fact” over whether or not Spacey acted with the purpose of gratifying “sexual desire” in allegedly forcibly touching Rapp’s “intimate parts”.Rapp alleged that Spacey “lifted him up” and “grazed” his buttocks over his clothing, before allegedly placing him on a bed and briefly placing his own “clothed body partially beside and across” his body. Rapp claims he “wriggled out” and left, according to the court documents obtained by Fox News.Spacey’s defence lawyers have said in a previous filing that the allegations are “false and never occurred”.In a 2017 tweet, Spacey wrote that he did not remember the alleged encounter and that he was “beyond horrified” to hear his story.Spacey appeared in the Manhattan court for an evidentiary hearing in May on the same day British prosecutors charged him with four counts of sexual assault against three men alleged to have occurred in London between 2005 and 2013.He was also charged with one count of “causing a person to engage in penetrative sexual activity without consent.” In a statement to the Good Morning America TV show, he thanked the Crown Prosecution Service’s statement that reminded the public he is innocent until proven otherwise and is entitled to a fair trial.“While I am disappointed with their decision to move forward, I will voluntarily appear in the UK as soon as can be arranged and defend myself against these charges, which I am confident will prove my innocence,” he said in the statement.British authorities had planned to seek extradition if Spacey did not attend voluntarily, according to Variety magazine.Actor Kevin Spacey and two of his businesses has been ordered to pay more than $40 million dollars to the producers of "House of Cards". In 2017, he was accused of sexual misconduct by more than 20 men, which he denies.The UK charges relate to two alleged incidents in London in 2005, another two and 2008, and a further incident in Gloucestershire, western England, in 2013.The alleged victim of the 2005 incidents is now in his 40s, while the two men allegedly involved in the 2008 and 2013 incidents are now in their 30s, London’s Metropolitan Police season said.The allegations emerged following the #MeToo movement, prompting an investigation by the Metropolitan Police and a review by London’s The Old Vic Theatre of Spacey’s time as artistic director between 2004 and 2015. The decision to charge Spacey “follows a review of the evidence gathered by the Metropolitan Police Service in its investigation,” the Met Police said in a statement. “The Crown Prosecution Service reminds all concerned that criminal proceedings against Mr Spacey are active and that he has the right to a fair trial,” they added.
